Terms of Service

These Terms of Service ("Terms") govern your use of cityskylinedecor.com (the "Site") and any purchase you make from City Skyline Decor, a brand operated by K94 Production LLC ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. By placing an order, you represent that you meet this requirement and that all information you provide is accurate.

2. Products and Pricing

We offer hand-printed 3D city skyline sculptures in three sizes (Small, Medium, Large) for select US cities. All prices are listed in US dollars and are subject to change without notice. We do our best to display accurate product information, but slight variations in color, finish, and detail may occur between hand-finished pieces. Photography on the site is representative; actual pieces may vary subtly.

3. Orders and Order Acceptance

When you place an order, you make us an offer to purchase the products in your cart at the listed prices. Your order is accepted only when we send you an order confirmation by email. We reserve the right to refuse or cancel any order, including for reasons such as suspected fraud, inventory issues, pricing errors, or shipping limitations.

If we cancel an order after charging your payment method, we will issue a full refund to the original payment method within 5 to 10 business days.

4. Payment

We accept payment via the methods supported by our payment processor, Stripe, including Visa, Mastercard, American Express, Discover, Apple Pay, and Google Pay. You authorize us to charge your selected payment method for the total amount of your order, including taxes and shipping.

You represent that you are authorized to use the payment method you provide. We are not liable for declined transactions, fraud-prevention holds, or other issues caused by your payment provider.

5. Shipping and Delivery

We ship to addresses in the United States and Canada. Standard shipping for orders under $50 is $6.99. Orders of $50 or more ship free. Production takes 1 to 3 business days; transit takes 3 to 5 additional business days for most US destinations. We are not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control.

Risk of loss passes to you when your order is delivered to the carrier. If your package is lost or damaged in transit, contact us within 14 days of the expected delivery date and we will work with the carrier to file a claim.

6. Returns and Refunds

We accept returns of standard, non-customized pieces within 30 days of delivery, in original condition, with original packaging. Custom-engraved pieces are not returnable except in the case of a defect or our error.

7. Intellectual Property

All content on the Site, including text, photography, designs, the City Skyline Decor name, logo, and the 3D skyline models themselves, is owned by K94 Production LLC or our licensors and is protected by US and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our content without our written permission. Personal, non-commercial use of the Site is permitted.

8. User Conduct

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to our systems, servers, or user accounts.
• Interfere with the operation of the Site, including via bots, scrapers, or automated tools, except as permitted by our robots.txt.
• Submit false or misleading information.
• Resell our products without our written authorization.

9. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY APPLICABLE LAW.

We do not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components. Hand-printed products may vary slightly from photography. Our products are decorative; they are not children's toys.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, K94 PRODUCTION LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE PRODUCTS YOU PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless K94 Production LLC, its officers, employees, and agents from any claim, damage, or expense (including reasonable attorney's fees) arising out of your violation of these Terms or your misuse of the Site or products.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of those courts.

Before filing any formal legal action, you agree to first contact us at hello@cityskylinedecor.com to attempt to resolve the dispute informally.

13. Changes to These Terms

We may modify these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be announced on the homepage. Continued use of the Site after a change constitutes acceptance of the revised Terms.
